Legal Guidebook for Aliens' Arrival & Departure & Residence in China

1.  Chinese law and regulations related to the aliens' fundamental rights:

According to Chinese law and regulations, aliens refer to those citizens who do not have Chinese nationalities.  As a country by law, China protects all the lawful rights and interests of aliens living in China and ensures their personal freedom and lawful property safe and secure.

2.  Chinese law and regulations related to the aliens' fundamental liabilities:

Aliens who live in China should abide by Chinese law and regulations, which means never do any activity to endanger national security, destroy social public interests and undermine social order.

An alien who breaks Chinese law and regulations, shall be prosecuted to take his liability according to Chinese administrative and criminal law by Chinese law-executing organs, and if he has injured another person or their personal property, shall take his civil liability as well. 

3.  What to do when the alien loses their certificates:

When the alien loses his passport or certificate, an alien should submit a report to the police station as soon as possible, and then take the receipt made by the police station to the exit=entry administration office in the county or municipal police bureau to complete the formalities.

The alien is required to tell the details of the event, such as when, where and how the event happened and the number of his passport and its expiration (expiry) date.

4.  Whether a foreign tourist can work in China:

Any foreigner who has not received the residence permits from the relevant agency of the Chinese government cannot have a work permit or be employed in China.

Aliens or foreigners who study in China, despite having residence permits, cannot have a work permit or be employed in China.

5.  How to make a temporary lodging registration when lodging in China:

In the event that an alien takes accommodations in the house of a Chinese resident; if the house is located in a city or a town, the host or the alien himself should, within 24 hours of the lodger's arrival, submit a report to the local public security agency together with the lodger's passport and other certificates and the host's residence booklet, and fill in the temporary lodging registration form.   If the house is located the countryside, the report should be submitted to the local police station or to the household registration office within 72 hours.

6.  How to make temporary lodging registration when the alien lodges in a resident foreign institution (hotel included) or at the house of another alien:

In the event that an alien accommodates at a resident foreign institution in China or at the house of another alien living in China, the host or the lodger himself shall, within 24 hours of the lodger's arrival, submit a report to the local public security agency together with the lodger's passport or residence permit, and fill in the temporary lodging registration form.

7.  Whether the foreigner can sleep outside:

In order to maintain the public sanitation and civilized image, aliens are not allowed to sleep outside in public places such as the airport, bus or train station, wharf, the sidewalk and so on.

8.  Whether China is open totally for aliens to travel:

At the present China is not totally open for aliens to travel.  Aliens are not allowed to travel to some places without the permission of the relevant government agencies. 

9.  Whether the aliens should carry certificates on them:

Aliens should carry their residence permits and passport with them for the examination by the police of foreign affairs when the occasion requires.
